01 Acceptance of Terms

These Terms & Conditions ("Terms") form a binding agreement between you ("User", "you") and 4Bigha ("4Bigha", "we", "us", "our"), the operator of the website 4bigha.com and related mobile, WhatsApp, and advisory services (together, the "Platform").

By creating an account, browsing listings, submitting a listing, purchasing a plan, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Refund & Cancellation Policy. If you do not agree, please discontinue use of the Platform immediately.

02 About 4Bigha

4Bigha is a technology platform that connects property owners, operators, hospitality and F&B brands, business sellers, and advisory-seeking users across India. We provide tools for listing discovery, enquiry routing, brand-to-asset matching, business-for-sale and joint-venture discovery, and on-ground advisory support.

4Bigha is an intermediary and facilitator only. We are not a party to, and assume no responsibility for, any lease, sale, joint-venture, franchise, or other agreement entered into between Users through the Platform.

03 Eligibility

  • You must be at least 18 years old and capable of entering into a legally binding contract under the Indian Contract Act, 1872.
  • If you register on behalf of a company, firm, brand, or other entity, you confirm you are authorised to bind that entity to these Terms.
  • We may refuse or revoke access at our discretion where eligibility criteria are not met or where fraudulent or misleading information has been provided.

04 Account Registration & Security

You agree to provide accurate, current, and complete information at registration (via email, Google sign-in, or mobile OTP) and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at contact@4bigha.com if you suspect unauthorised access.

05 Platform Services

Depending on your community/role (Owner, Operator/Investor, Brand, Business Seller, Associate/Partner, or Advisory client), the Platform may offer:

  • Listing creation and management for hospitality, commercial, and business-for-sale assets;
  • Search, discovery, and enquiry tools across the Marketplace, Business for Sale, Joint Ventures, and Brand Explorer sections;
  • Lead routing between owners, brands, operators, and investors;
  • Hospitality and commercial leasing advisory services; and
  • Associate/partner referral programmes.

We may add, modify, or discontinue any feature or service at any time without prior notice, and we do not guarantee any particular outcome (such as a completed lease, sale, or deal) from use of the Platform.

06 Listings & User Content

Users who submit listings (including property details, pricing, photographs, floor plans, or business financials) are solely responsible for the accuracy, legality, and completeness of that content ("User Content"). By submitting User Content you represent that you have the right to list the asset and to share the information provided.

All listings submitted through the Platform are reviewed by our team before publication and may be edited for formatting, verified, flagged, rejected, or removed at our sole discretion — including where we reasonably believe content is inaccurate, misleading, duplicate, or non-compliant with law.

You grant 4Bigha a non-exclusive, royalty-free, worldwide licence to host, display, reproduce, and distribute your User Content on the Platform and in related marketing (e.g. featured-listing placements) for as long as your listing remains active, and for a reasonable period thereafter for record-keeping.

07 No Brokerage / Not a Registered Real Estate Agent

4Bigha is a discovery and advisory platform, not a licensed real estate broker, valuer, or registered real estate agent under the Real Estate (Regulation and Development) Act, 2016 ("RERA") or any state RERA rules, unless expressly stated for a specific listing. Where a listing pertains to a RERA-registered project, the relevant RERA registration number and disclosures are the responsibility of the listing owner/developer, and Users are encouraged to independently verify such registration on the applicable state RERA website before transacting.

4Bigha does not conduct independent legal, title, structural, or financial due diligence on listed assets or businesses. Users must independently verify ownership, title, permits, licences, RERA status, statutory approvals, and financial representations before entering into any transaction, and are strongly encouraged to engage qualified legal and financial advisors.

08 Fees, Plans & Payments

  • Certain features (e.g. publishing a listing, featured placement, advisory engagements, partner/associate plans) require payment of applicable fees as displayed on our Pricing page at the time of purchase.
  • All fees are quoted in Indian Rupees (₹) and are exclusive of applicable taxes (including GST) unless stated otherwise; taxes will be added at checkout where applicable.
  • Subscription plans, where offered, may auto-renew at the then-current rate unless cancelled prior to the renewal date through your dashboard or by writing to us.
  • Payments are processed by third-party, PCI-DSS-compliant payment gateways. 4Bigha does not store your full card, UPI, or net-banking credentials.
  • Refunds and cancellations are governed by our separate Refund & Cancellation Policy, which forms part of these Terms.

09 Prohibited Conduct

You agree not to:

  • Upload false, misleading, defamatory, infringing, or unlawful content, or impersonate any person or entity;
  • Circumvent the Platform to avoid applicable fees, or solicit Users off-platform to evade our processes;
  • Scrape, harvest, or extract data from the Platform using automated means without our written consent;
  • Upload malicious code, attempt to breach security, or interfere with the Platform's normal operation;
  • Use the Platform for any purpose that is unlawful or prohibited by these Terms; or
  • Send unsolicited commercial communications to other Users obtained through the Platform.

Violation may result in content removal, account suspension or termination, and, where applicable, referral to law-enforcement authorities.

10 Communications & Marketing Consent

By registering, submitting a listing, or submitting an enquiry, you consent to receive service, transactional, and (where you have not opted out) promotional communications from 4Bigha via email, SMS, phone call, and WhatsApp (including via our messaging partner, Wati Technologies), regarding your account, listings, enquiries, and relevant offers. Transactional messages (e.g. listing status updates, OTPs, enquiry acknowledgements) are sent as part of core service delivery and cannot be opted out of while your account remains active. You may opt out of promotional messages at any time by replying "STOP" on WhatsApp/SMS, using the unsubscribe link in emails, or writing to contact@4bigha.com. 11 Intellectual Property

The 4Bigha name, logo, website design, software, and all associated trademarks and content (excluding User Content) are the exclusive property of 4Bigha or its licensors. You may not copy, modify, distribute, or create derivative works from the Platform without our prior written consent.

12 Third-Party Services & Links

The Platform relies on third-party infrastructure and service providers, including but not limited to Supabase (data hosting), Wati Technologies (WhatsApp Business messaging), email delivery providers, and payment gateways. The Platform may also link to third-party websites. We do not control and are not responsible for the content, policies, or practices of third-party services or sites; your use of them is subject to their own terms and privacy policies.

13 Disclaimers

THE PLATFORM AND ALL CONTENT, LISTINGS, AND INFORMATION MADE AVAILABLE THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT LISTINGS ARE ACCURATE, COMPLETE, OR CURRENT, OR THAT THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

14 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 4BIGHA, ITS FOUNDERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM OR ANY TRANSACTION FACILITATED THROUGH IT. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO 4BIGHA IN THE 12 MONTHS PRECEDING THE CLAIM.

15 Indemnification

You agree to indemnify and hold harmless 4Bigha and its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your User Content, or your violation of any law or third-party right.

16 Suspension & Termination

We may suspend or terminate your account and access to the Platform, with or without notice, for breach of these Terms, suspected fraud, non-payment, or at our reasonable discretion to protect the integrity of the Platform. You may close your account at any time by writing to contact@4bigha.com. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) shall continue to apply.

17 Governing Law & Jurisdiction

These Terms are governed by the laws of India. Subject to Section 18 below, the courts at Udaipur, Rajasthan shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of the Platform.

18 Dispute Resolution

In the event of any dispute, you agree to first contact us at contact@4bigha.com so we can attempt to resolve the matter informally within 30 days. If unresolved, the dispute shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by mutual consent, seated in Udaipur, Rajasthan, with proceedings conducted in English.

19 Changes to these Terms

We may update these Terms from time to time to reflect changes in our services or applicable law. Material changes will be notified via the Platform, email, or WhatsApp at least 7 days before taking effect. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. The "Last updated" date above indicates the most recent revision.
